May 30, Artsakh Republic National Assembly convened its regular sitting.
Opening the sitting, the Head of the National Assembly Ashot Ghoulyan touched upon the inter-parliamentary cooperation between the two parliaments of the two Armenian states organized in the RA NA last month. Also discussing the implementation of 2018 state budget performance was launched in the National Assembly in May.
Before approving the agenda of the sitting, according to Article 34 of the NA Rules of Procedure, the draft law of the Artsakh Republic "On Making Amendment to the NKR Law" On Honorary Titles of the Nagorno Karabakh Republic ", which has a negative conclusion, was put on a short discussion at the request of the author. Lyudmila Barseghyan proposed to include the draft into the agenda and discuss it in the sitting which will take place in June.
The Head of the Commission and Chair of the Standing Committee on Budget, Financial and Economic Management, Aram Grigoryan supported the author’s offer and expressed hope that after making some clarifications, the project will be included into the agenda of the upcoming sitting. The Parliament voted for inclusion of the draft into the agenda of the sitting.
After approving the agenda of the sitting, parliamentarians passed to the discussion of mandatory issues.
Presenting the 2018 Human Rights Defender activities as well as the report on the state of protection of human rights and freedoms, the Human Rights Defender of the Artsakh Republic, Artak Beglaryan noted that in the reporting year 138 applications have been received from 159 persons on social security, property, fair trial, free movement, working and proper administration rights. In his report, the Human Rights Defender also referred to the fact of Artsakh becoming the party of the international conventions and proposed to discuss “Children's Rights", "On the Rights of Persons with Disabilities" and "Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment" and the possibility of joining the international conventions. After the presentation Artak Beglaryan answered the MPs' questions.
The report on the 2018 Artsakh Public TV and Radio Company activity has been presented to the parliament by the Chairman of the Board Arsen Arstamyan. According to him, the company has successfully completed the year both in production and in financial and economic terms. Arsen Arstamyan also answered the MPs’ questions.
The other issue on the agenda was the discussion of the interrogation of Hayk Khanumyan, a member of the "Renaissance" faction. The issue was addressed to the government of Artsakh Republic concerning clarification of the conditions of privatization of Artsakhgas and Artsakhenergo companies. Minister of Economy and Industrial infrastructures Levon Grigoryan, responding to a question, said that the companies were privatized by the government in accordance with the decisions of the 2017 competition. Coming up with a speech on interrogation, Hayk Khanumyan noted that the answer provided by the Government does not dispel his suspicions. The MP also inquired about investment volumes of the discussed companies and fulfillment of the conditions provided by the contract of privatization.
During the exchange of thoughts on the procedure MP Artur Tovmasyan made a speech. Levon Grigoryan and Hayk Khanumyan made the final speeches.
Starting with legislative work, the parliament debated and adopted in the second reading the laws of the Artsakh Republic “On Normative Legal Acts" presented by Justice Minister Ararat Danielyan and “On the State Courier Service" presented by National Security Service Director Samvel Shahramanyan.
The Draft law of the Artsakh Republic “On the Investigative Committee of the Republic of Artsakh” with the accompanying package was presented to the NA for discussion was submitted by the Justice Minister Ararat Danielyan. According to him, with the adoption of the bill an investigation committee will be set up, the unity of the preliminary investigation bodies operational principles will be ensured, the independence of investigative bodies will be guaranteed and procedural autonomy, the unity of investigators' status, more effective implementation of the preliminary investigation. That will help to strengthen the protection of the rights and legitimate interests of citizens in pre-trial criminal proceedings and to eliminate the repetitive functions of law enforcement agencies and to optimize budgetary expenditures.
Chair of the Standing Committee on State and Legal Affairs Hovik Jivanyan presented positive conclusion of the committee on the draft and answered the MPs' questions. The parliament has considered and passed the law in the first reading.
The Justice Minister then presented a package of the draft Law of the Artsakh Republic "On Making Amendments and Addenda to the NKR Law" On Notary ". According to the minister, the adoption of the package will ensure the normal functioning of the provisions set out in the NKR Law "On Notary" and will address the problems arising in connection with ensuring the continuity of the notary operations. After receiving the endorsement of the NA Standing Committee on State and Legal Affairs, the parliament approved the draft law.
The other project of the justice sector was the draft law of the Artsakh Republic "On Making Additions and Amendments to the Criminal Procedure Code of the Nagorno Karabakh Republic" with the adoption of which according to Minister Danielyan an increase the effectiveness of organizing investigative activities is expected, eliminating the legitimate aim of attracting audiences.
The parliament subsequently heard the Draft Law of the Republic of Artsakh "On Making Addendum to the NKR Electoral Code" by MP Eduard Aghabekyan by which the necessity of debates between the presidential candidates on the live broadcast of Artsakh Public Television will be approved during the election of the president of the republic.
The MPs asked the author of the bill, after which the authorized representative of the government, Minister of Justice Ararat Danielyan made a report on the project.
After receiving a positive conclusion of the Leading Standing Committee on State and Legal Affairs an exchange of opinions took place, after which David Ishkhanyan made a speech. The author of the project made a final speech. With 20 votes in favor, 6 abstentions, the law was passed in the first reading.
Chairman of the Civil Service Council Boris Arushanyan presented the draft law of the Artsakh Republic "On Making Amendments and Addenda to the NKR Law" On Civil Service "aimed at bringing it in line with the Constitution of the Republic of Artsakh. The Standing Committee on State and Legal Affairs gave a positive conclusion on the draft law and the law was adopted following the voting results.
Presenting the package of laws of the Artsakh Republic "On Seismic Protection", "On Making Amendment and Addendum to the NKR Law on Local Self-Government", Director of the State Service for Emergency Situations Levon Mnatsakanyan noted, that the adoption of the package is aimed at clarifying a number of concepts and provisions of the Law of the Artsakh Republic "On Seismic Protection", the application of methods and principles of seismic safety in order to complement the implementation of measures, the powers of clarification and separation, establishing the powers of local self-governing bodies in seismic safety as a mandatory authority to improve the legal field regulating the field, as well as bringing the existing regulations into line with existing legislation. The minister answered the questions of the MPs. The Chair of the NA Standing Committee on Defense, Security and Law Enforcement Affairs Zhanna Galstyan presented the endorsement of the committee, after which the parliament voted for the law in the first reading.
Justice Minister Ararat Danielyan presented the law of the Artsakh Republic "On the Legal Regime of the State of Emergency" to the National Assembly for the first reading. According to the minister, the adoption of the bill is expected to regulate the peculiarities of the legal regime of the state of emergency in the Artsakh Republic, as well as possible guarantees for ensuring the fundamental rights and freedoms of the person and citizen during the state of emergency.
By the endorsement of the Standing Committee on Defense, Security and Law Enforcement, the parliament passed the law in the first reading.
Minister of Economy and Industrial Infrastructure Levon Grigoryan proposed to debate draft law on Artsakh State Property Privatization Program 2019-2022 in the first reading. According to the minister, the adoption of the bill is conditioned by the need to fulfill the requirements of Article 4 of the NKR Law on State Property Privatization aimed at promoting the solution of the problems identified in the basic directions of social and economic development and fiscal policy.
After listening to the proposal of Hovik Jivanyan, Chair of the Standing Committee on Budget, Financial and Economic Management Aram Grigoryan proposed to adopt the law in the first reading to continue the discussion of the proposals submitted. The law was adopted in the first reading in the ratio of 19, 3, 3 and 3 abstentions.
Introducing the draft law of the Artsakh Republic "On Making Addenda to the Artsakh Republic Law on the Status of Military Service and Military Status", the Minister of Defense of the Artsakh Republic Karen Abrahamyan noted that the adoption of the law will ensure the proper organization of the postponement of compulsory military service drafting for targeted military service during compulsory military service : The Standing Committee on Defense, Security and Law Enforcement issued a positive conclusion on the draft law. The law has been adopted.
The Minister of Nature Protection and Natural Resources Felix Gabrielyan presented to the MPs a discussion on Making Amendments and Additions to the NKR Law on Waste, on Amending the NKR Law on Licensing, "About the Republic of Artsakh". The Minister noted that here it is expected to clarify the process of issuing licenses, providing the licensee with a document certifying the right to engage in activities that are preferable to them, which will create the most favorable conditions for the enterprises involved in the use of hazardous waste.
By the endorsement of the NA Standing Committee on Production and Industrial Infrastructure, the law has been passed.
Presenting the draft law "On Making Amendments to the NKR Law on Motor Roads", Minister of Urban Development Karen Shahramanyan stressed that the amendment will allow to alter different legal acts with each other, centering on the maintenance, exploitation and maintenance of regional roads. After listening to the endorsement of the NA Standing Committee on Production and Industrial Infrastructure, the parliament passed the law.
